STYL. is an app created and provided by Nome Technologies LLC, a Colorado business (“we”, “us”). These terms are an agreement between you and Nome Technologies LLC. By using the app you accept them. Please read the sections on palette content: Nome Technologies LLC offers the color palettes under a license from Global Color Analysis, and they carry real restrictions.
1. Accepting these terms
STYL. (the “app”) is made and published by Nome Technologies LLC, a Colorado business (“we”, “us”). By downloading, opening, or using the app you agree to these Terms of Use with Nome Technologies LLC. If you do not agree, do not use the app. You must be at least 13 years old to use STYL.; if you are under the age of majority where you live, a parent or guardian must agree to these terms for you. If we make a material change to these terms, the app will ask you to accept the updated version.
These terms are between you and Nome Technologies LLC only, and not with Apple. Apple is not a party to them. Nome Technologies LLC — not Apple — is solely responsible for STYL. and for everything in it. Nothing in these terms conflicts with the Apple Media Services Terms and Conditions, and if anything here were read to conflict with the usage rules in those terms, those usage rules govern.
2. What a purchase gives you
Palettes are normally sold individually:
- Lifetime palette license — a one-time purchase giving you ongoing access to that one palette.
- Annual palette subscription — access to that one palette for a year, renewing until canceled.
Three other purchases exist:
- Consultant Package — a one-time purchase giving ongoing access to every palette in the app, and the ability to buy palette codes to send to other people. It does not renew.
- Palette code — a one-time purchase of a code for one palette, at the same price as that palette. What you buy is a code to give to someone else, not access for yourself. A code never expires, can be redeemed once, and once redeemed cannot be returned or reissued by us.
- Gifted palette — the free purchase the app completes on your own Apple Account when you redeem a code someone sent you. It costs nothing, now or later, and does not renew.
Except for the Consultant Package, a purchase applies only to the palette you bought. You cannot switch an existing purchase or subscription to a different palette; to add another palette, buy that palette. The app does not offer free trials of palettes.
3. Billing, renewal, and cancellation
All purchases are processed by Apple through your Apple Account. Annual subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
The other purchases do not renew and are charged once: a lifetime palette license, the Consultant Package, and a palette code. Redeeming a code someone sent you costs nothing and never becomes a subscription — it is a free purchase on your own Apple Account, which is what lets you restore that palette later on your other devices.
You can view, manage, or cancel subscriptions in Settings on your device, under your Apple Account. Refunds are handled by Apple under Apple’s policies, not by Nome Technologies LLC. Because a palette code can only ever be redeemed once, we cannot reissue or replace one that has been used.
4. Who owns the palettes
The color palettes in this app are the property of Global Color Analysis. Nome Technologies LLC, which created and provides STYL., holds a license from Global Color Analysis to offer them in the app. Global Color Analysis keeps all rights to the palettes. Nome Technologies LLC owns the app itself — its software, design, and features.
You get a personal, non-exclusive, non-transferable, revocable license to view the palettes you have purchased, inside this app, for your own personal use.
That license is to use STYL. on any Apple-branded product that you own or control, and only as the Apple Media Services Terms and Conditions permit. Where those terms allow it, members of your Family Sharing group, and accounts associated with yours through volume purchasing, may also use the app.
5. What you may not do with palette content
You may not:
- copy, export, extract, scrape, or otherwise collect the palettes or their underlying color values out of the app, by any means, including automated ones;
- reproduce, publish, share, sell, or redistribute the palettes or any part of them, whether as color values, lists, files, images, or printed material;
- use the palettes to build, train, or supply any other product, service, dataset, or color-analysis system; or
- reverse engineer, decompile, or attempt to extract the app’s stored palette data.
Palettes are displayed as visual swatches only. Sharing your device or Apple Account to give other people access to palettes you purchased is not permitted.
6. Your photos, scans and notes
Scanning uses your camera or a photo you choose, and happens entirely on your device. Saved scans and liked colors stay on your device. Your photos leave it only for your own iCloud storage — while iCloud sync is on, and for photos you pin to a board or add to the Library whether or not it is — or if you share a closet or a board, or send a closet as a file. Your name travels in the title of what you share, on notes you sign, in a closet you send as a file, and to us if someone reports a note you wrote. Apple's iCloud sharing also shows the people you connect with the name on your Apple Account, and the app displays it. See the Privacy Policy for detail.
You are responsible for what you share and for the notes you write. There is no tolerance for objectionable or abusive content: do not share or write anything that is harassing, threatening, hateful, sexually explicit, unlawful, or that infringes someone else's rights, and share only photographs you have the right to share. Any note written to you can be reported by pressing and holding it, and its writer can be blocked, which removes their notes from your device and ends sharing with them. We review each report within 24 hours and act on it under Section 9, which can include ending the writer's access. Before a note is sent, your device checks it for objectionable words and stops it if it finds one; nothing is sent to us for this.
7. About color accuracy
STYL. shows color as faithfully as a screen allows, but a screen is not a fabric swatch. What you see depends on your display, its brightness, ambient light, and iOS features such as True Tone and Night Shift, which deliberately shift screen color. For the most consistent results, view palettes at high brightness in daylight with True Tone and Night Shift turned off.
Scan matches are a guide, not a measurement. Camera color depends on lighting and exposure. Use your own judgment for decisions that matter, and compare items in person where you can.
8. Changes to the app and to palettes
We may update, change, or discontinue features of the app. Palette content is governed by our license with Global Color Analysis, and changes to palette composition are made only as that license allows. If a palette must be withdrawn, we will honor existing lifetime purchases to the extent our license permits, and handle subscriptions by either serving out the paid period or refunding it on a pro-rata basis.
9. Ending your access
We may suspend or end your access if you breach these terms, in particular the restrictions in Section 5 or the rules on notes and sharing in Section 6. You may stop using the app at any time; deleting the app removes the data stored on your device.
10. Disclaimers and limits
The app is provided “as is,” without warranties of any kind, to the fullest extent the law allows. Nome Technologies LLC is not liable for indirect, incidental, special, or consequential damages. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim. Nothing here limits rights you have under consumer law that cannot be waived.
If STYL. does not conform to any warranty that does apply, you may tell Apple, and Apple will refund what you paid for the app. To the maximum extent the law allows, that refund is Apple's entire warranty obligation to you. Any other claim, loss, liability, damage, cost or expense arising from a failure to conform to a warranty is Nome Technologies LLC's responsibility, not Apple's.
11. Governing law
These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Colorado.
12. Apple's role
These terms include the following because Apple requires them of any app that supplies its own terms of use.
Support. Nome Technologies LLC is solely responsible for maintaining and supporting STYL., as these terms or the law require. Apple has no obligation whatsoever to furnish any maintenance or support for the app.
Claims about the app. Nome Technologies LLC, not Apple, is responsible for addressing any claim you or a third party make about STYL. or your use of it. That includes product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law.
Intellectual property. If anyone claims that STYL., or your use of it, infringes their intellectual property rights, Nome Technologies LLC alone is responsible for investigating, defending, settling and discharging that claim.
Where you may use the app. You confirm that you are not located in a country subject to a United States Government embargo, or that the United States Government has designated as supporting terrorism, and that you are not listed on any United States Government list of prohibited or restricted parties.
Other people's terms. You must comply with any applicable third-party terms when using STYL. — for example, the terms of your wireless data plan.
Apple's right to enforce. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. On your acceptance of them, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.
